Minimum Wages & categories of semi-skilled, skilled and highly skilled workers in 42 types of establishments declared by the Sindh Govt.
1- The Sindh Govt. has notified the Minimum Wages for various categories of semi-skilled, skilled and highly skilled workers working in 42 types of establishments in the Province of the Sindh at
different rates of Rs. 26,000/= p.m., Rs. 31,961/= p.m. and33,491/= p.m. respectively w.e.f. 01-01-2023 under Section 5 of the Sindh Minimum Wages Act, 2015 on recommendation of its Minimum Wages Board as per the revised Sindh Govt. Gazette Notification dated 28-04-2023.
2- The Notification is contradictory as it includes categories of employees such as supervisory and above categories who are not worker under the definition of worker in the Sindh Payment of Wages Act, 2015.
3- The Notification also provides that other matters shall be regulated by the Sindh Factories Act, 2015, Payment of Wages Act and other relevant Labour Laws.
4- This minimum wage declared is inclusive of basic wage and all other regular allowances whatsoever. If the present wage of any semiskilled, skilled and highly skilled workers, adult, male and female workers, is higher than the minimum wage declared now, their current wages cannot be reduced. This minimum wage is also applicable to probationary, temporary and piece rated workers.
5- Please note that this Notification is a separate Notification specifically for the semi-skilled, skilled and highly skilled categories of workers, over and above the Minimum Wages of Rs. 25,000/= p.m.
for unskilled workers as Notified by another Notification dated 07-07-2022 (see our circular No. 200 dated 13-07-2022).
6- This Notification of Minimum Wages for various categories of semiskilled, skilled and highly skilled workers should have been notified immediately after the Minimum Wages of Rs. 25,000/= p.m. for
unskilled workers but it has been delayed, unnecessarily.
7- If any employer has any other category which is not included in the schedule Annexure- A of 42 types of establishments, the employer may follow the appropriate place/category in the schedule.
8- Contributions and other matters under the Social Security and EOB shall be governed by the provisions of these laws.
9- The above may be carefully read along with the Gazette Notification. In case of any doubt, you should consult your Labour Laws Consultant.
10- Similar legal steps on the Minimum Wages by other provinces are awaited.
