Further amendments made by the Parliament in the amendments in the Labour Laws given in the Finance Bill
Further to our Circular No. 109 dated 22-06-2006 we have now been able to get a copy of the amendments made by the Parliament in the Finance Bill as passed by it which includes three Labour Laws also as given below:-
1. The Factories Act, 1934: –
(a.) In Section 45 (1) (b), for the first proviso the following has been substituted:
“Provided that if the employer arranges for the transport facilities a woman with her consent may work up to 10.00 p.m. in two shifts.”
Notice addition of the words “with her consent” thereby a women worker cannot be forced to work in night shift even if transport is provided by the employer.
(b.) The second proviso of Section 45 (1) has been omitted.
2. The W.P. Industrial & Commercial Employment (S.O.) Ordinance, 1968: –
The clause (g) after clause (f) given in our Circular has been substituted as under:-
“(g) A “contract worker” is a workman who works on contract basis for a specified period on remuneration to be calculated on piece rate basis.”
The word “of” is not correct, it should have been “on”.
3. W.P. Shops and Establishment Ordinance, 1969: –
The proviso in Section 9 as given in para 4 of our Circular has been substituted as under:-
“Provided that no over time shall be payable to the contract worker employed on piece rate basis.”
